Terms of service

Your signed proposal and agreement set the exact terms for your project. This page explains how we work in plain English. If anything here differs from your signed agreement, the agreement wins.

Who we are

Digital Works Forge is a web design studio in San Antonio, Texas, building websites for small businesses here and across the U.S. We work by appointment. Text (210) 439-4188 or email forge@digitalworksforge.com, or call.

A quote request is a question, not a contract

Sending a quote request, a Get started form or a message asks a question. It doesn't commit either of us. Work starts only after we both sign a proposal and your deposit is paid.

Payment

Every project has a fixed price, set in your proposal. Package prices are on our pricing page. You pay through Stripe: a 50% deposit when you sign, and the other 50% before launch or hand-off. The deposit is non-refundable, apart from the exceptions in your signed agreement. Your agreement sets payment due dates and what happens if a payment is late.

Revision rounds and fix windows

Each package includes a set number of revision rounds before launch. In a round, you send your changes as one list and we make them together. A fix window starts at launch: for that many calendar days, we correct anything that doesn't match the agreed scope, at no extra charge.

  • Spark: 1 revision round, 7-day fix window
  • Forge: 2 revision rounds, 14-day fix window
  • Forge Plus: 3 revision rounds, 30-day fix window
  • Storefront: 3 revision rounds, 30-day fix window

Changes you ask for after approval, and problems caused by outside services, fall outside the fix window.

Changes to your project

If you want something your proposal doesn't include, such as an extra page or revision round, we write it up as a change order with a fixed price. You approve it in writing and pay for it before that work starts. A change order doesn't change your package price, and nothing is billed by the hour.

Not included unless added in writing: logo design, photography, heavy copywriting, ongoing SEO, ads, social management, and ongoing Google Business Profile management.

Your materials and accounts

After the deposit, you send the logo, photos, words and business details for your site. By sending them, you confirm you have the right to use them and that they are accurate. Everything you supply stays yours.

When we need access to an account, such as your domain or hosting, invite us as a user. Never send passwords, card numbers or keys by email or text; we will never ask for them. Silence is not approval: we launch only after you approve the site and your final payment clears.

Who owns the site

Once your final payment clears, the custom design and content we made for your site are yours. Our builder, tools, templates and reusable parts stay ours. Anything of ours built into your site comes with a permanent license at no extra cost, so you can keep using and changing your site, including with another developer or host. Stock photos, fonts, plugins and other outside items follow their own licenses, and we list them for you at hand-off.

Your domain and hosting

Your domain always stays in your name. Host the site in your own account, or let us host it on a care plan, and take it with you any time.

  • In your own account, without a care plan: you pay the hosting bill directly. At hand-off we check that the site works in your account, then remove our access.
  • On a care plan: we host the site for you. You can move it whenever you like; your signed agreement sets the notice period and what we hand over.

Delays

Timelines are estimates and depend on getting your materials and feedback on time. If we go about 14 days without something we need from you, we may pause the project and reschedule it, after telling you in writing.

Ending a project

Either of us can end a project with written notice. Your signed agreement explains the notice period, what is owed for work done so far, and any refund.

No promise of results

We build every site with care, but we don't promise search rankings, leads or sales, or that a site will never go down.

Using this website

The text, design and logo on digitalworksforge.com belong to Digital Works Forge. The site is provided as is, without a promise that it is free of errors or always available. Links to other websites are there for convenience; we don't control those sites and aren't responsible for them.

Privacy

How we collect and use your information is explained in our privacy policy.

Texas law

Texas law applies to these terms. We'll first try to settle any disagreement by talking it through in writing. If that doesn't work, the courts in Bexar County, Texas, handle it, unless the law requires otherwise.

Changes to these terms

We may update this page. When we do, the “Last updated” date at the top changes. An update doesn't change an agreement you have already signed.
